completeness or accuracy of GIS Inquiry or its fitness for a particular
purpose. GIS Inquiry represents a one-time capture of information as it
exists at the time the information is transferred to GIS Inquiry and
does not necessarily include the ongoing updates or corrections to the
source database maintained by the City or other agencies and included
for the City's internal purposes.
The User will use GIS Inquiry only for the User's own internal
business and personal purposes and may not
re-sell, sublicense, or operate a service bureau using GIS
Inquiry, or
otherwise reproduce, publish or disseminate GIS Inquiry for
commercial purposes,
without the prior written consent of the City.
All right, title and interest (including all copyright, patent, and
other intellectual property rights) in GIS Inquiry remain vested in the
City at all times. The City's original copyright and other proprietary
notices included with GIS Inquiry must remain intact at all times.
The User now indemnifies the City and its officials, employees and
agents from and against all losses, claims, demands, actions, payments,
expenses, costs, suits, and damages (including any damages that are
direct, indirect, incidental, special or consequential), whether or not
caused by the negligence of the City, or its officials, employees or
agents, which are incurred by the City and would not or could not have
been incurred but for the User's use of GIS Inquiry or the User's breach
of these Terms of Use.
On completion of each transaction for which the GIS Inquiry data is
acquired, the User will erase the GIS Inquiry data from the User's
computer system or such other storage device where such data may reside
and will, upon the City's written request, provide written confirmation
of compliance to the City's Director of Information Technology.
Failure of the User to comply with these Terms of Use will result in
the automatic termination of the User's rights to access GIS Inquiry.
Please note that you may encounter problems trying to locate
addresses on Sea Island due to the nature of some of the property
(parcel) sizes there. Specifically, when searching for addresses
on Sea Island, you may receive the message “Invalid Address” even though
the address does exist.
These Terms of Use are governed by the laws of British Columbia,
Canada. If any part of these Terms of Use are found to be unenforceable,
then that part will be severed so that the remainder of these Terms of
Use can continue to be enforceable.
